These Terms & Conditions apply to all purchases made through the online store operated by Nathalie Broeze.

Each original painting is an individual work of art. Because original artworks are handmade, minor variations in texture, colour, brushwork and finish are inherent to the nature of the artwork and are not considered defects.
Colours may also appear slightly different depending on your screen, device and display settings.
3. Original artwork
Original paintings are unique artworks. Once an original artwork has been sold, it may no longer be available.
The purchase of an original artwork does not transfer copyright or other intellectual property rights to the buyer. Copyright remains with Nathalie Broeze unless otherwise agreed in writing.
4. Prints
Prints are produced on premium canvas.
Minor differences between a digital image displayed on the website and the physical print may occur due to differences in screens, printing processes and materials.
5. Commissioned artwork
Commissioned artwork is created specifically for the customer based on an agreed concept, size, colour palette, style and/or other requirements.
Before work begins, the relevant specifications and price will be agreed with the customer.
Because commissioned artwork is created specifically for an individual customer, the statutory right of withdrawal may not apply where the artwork qualifies as a product made to the consumer's specifications or clearly personalised.
The customer is responsible for providing accurate information and specifications required to create the commissioned artwork.
Once the commission has been accepted and production has started, cancellation may be subject to costs already incurred.
Any specific cancellation arrangements for a commission will be communicated to the customer before the commission is accepted.
6. Prices
All prices displayed on the website are stated in euros unless otherwise indicated.
Prices may include applicable VAT where required.
Shipping costs, if applicable, are displayed during the checkout process before the order is completed.
We reserve the right to correct obvious pricing or typographical errors.
7. Placing an order
When placing an order, you are responsible for providing accurate and complete information.
After submitting an order, you will receive an order confirmation by email.
An order is considered accepted when we confirm the order, subject to availability and applicable consumer law.
8. Payment
Payment must be completed using one of the payment methods available at checkout.
If payment cannot be completed or is reversed, we may suspend or cancel the order in accordance with applicable law.

We ship to the countries listed on our website and at checkout.

Delivery times depend on the destination, the product purchased and the shipping method selected.
An estimated delivery time will be communicated where possible.
International customers are responsible for any applicable customs duties, import taxes or other charges imposed by the destination country, unless explicitly stated otherwise at checkout.
10. Risk during shipping
We take reasonable care to package artwork securely for transportation.
If your order arrives damaged, please contact us as soon as possible and provide photographs of the packaging and artwork so that we can assess the issue and determine the appropriate solution.
Your statutory consumer rights remain unaffected.
11. Right of withdrawal
If you are a consumer purchasing a standard product online, you generally have a statutory right to withdraw from the purchase within 14 days without giving a reason.
The withdrawal period generally begins on the day after you, or a person designated by you, receives the product.
To exercise your right of withdrawal, you must clearly inform us within the applicable withdrawal period.

After notifying us of your withdrawal, you must return the product within the applicable statutory period.
Unless otherwise required by law, you are responsible for the direct cost of returning the product.
The product should be returned in an appropriate condition and, where reasonably possible, in its original packaging.
12. Exceptions to the right of withdrawal
The right of withdrawal does not apply in cases where an applicable legal exception exists.
This may include artwork that has been made to the customer's specifications or is clearly personalised, such as certain commissioned paintings.
If an exception applies, this will be communicated to you before the order or commission is accepted.
13. Refunds
If you validly withdraw from a purchase, we will refund the payments received from you in accordance with applicable law.
Refunds will generally be made using the same payment method used for the original transaction, unless another method has been agreed.
We may wait with the refund until we have received the returned product or until you provide evidence that the product has been returned, whichever occurs first, where permitted by law.
14. Faulty or damaged products
Nothing in these Terms & Conditions affects your statutory rights concerning products that are defective, damaged or do not conform to the agreement.
If you receive a damaged or defective product, please contact us as soon as reasonably possible.
15. Intellectual property
All artwork, photographs, images, text, logos, designs and other content displayed on this website are protected by applicable intellectual property laws.
Unless explicitly agreed otherwise, purchasing artwork does not give you permission to reproduce, distribute, commercially exploit or otherwise use the artwork or website content for commercial purposes.
16. Personal use
Unless otherwise agreed, purchased artwork is intended for personal use and display.
The buyer may not reproduce the artwork commercially or use it to create derivative products for sale without prior written permission.

These Terms & Conditions are governed by Dutch law, without prejudice to any mandatory consumer protection provisions that may apply in your country of residence.

The version applicable to your purchase is the version in force at the time your order was placed.
